Terms and Conditions





1. Definitions

The terms used in these Terms and Conditions shall mean:


  1. FPHU KRAKPOL – Marek Prokopik conducting business under the name “Marek Prokopik FPHU KRAKPOL” (address: ul. Dobrego Pasterza 99D, apt. 38, 31-416 Kraków), identified by NIP: 6781289492 and REGON: 123071766, and Sławomir Prokopik conducting business under the name “Sławomir Prokopik AGENCJA ARTYSTYCZNA PRO-ARTS” (address: Osiedle Piastów 31, apt. 17, 31-624 Kraków), identified by NIP: 6782861497 and REGON: 120412184, acting as partners in a civil law partnership: FPHU KRAKPOL S.C. M.S. PROKOPIK (address: Rynek Główny 10, 31-042 Kraków), identified by NIP: 6762254618 and REGON: 356782550.
  2. Terms and Conditions – these terms and conditions available in the Service at: https://www.cracowconcerts.com/terms-and-conditions.
  3. Service – the website available at: www.cracowconcerts.com.
  4. User – a natural person having full legal capacity, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, using the functionalities of the Service, including in particular entering into a Ticket sales agreement with FPHU KRAKPOL.
  5. Consumer – a User who is a natural person entering into an agreement with FPHU KRAKPOL not directly related to his business or professional activity.
  6. Concert – an event organized by the Organizer under the rules specified by the Organizer, for which tickets are sold through the Service.
  7. Organizer – a natural person having full legal capacity, a legal person, or an organizational unit without legal personality to which the law grants legal capacity, who organizes the Concert; the Organizer may also be FPHU KRAKPOL.
  8. Ticket – a document authorizing the Customer to enter a specified Concert.
  9. Electronic Ticket – a Ticket stored in electronic form.
  10. Personalized Ticket – a Ticket containing the personal data of the person authorized on its basis to enter a specified Concert.
  11. Discount Ticket – a Ticket available for purchase at a reduced price by pupils and students up to 26 years of age holding a valid document confirming pupil or student status.
  12. Order – submission by the Customer of an offer to purchase a Ticket in the Service.
  13. Participant – a person participating in a Concert organized by FPHU KRAKPOL on the basis of a Ticket.
  14. Newsletter – an electronic form of FPHU KRAKPOL’s information bulletin and sent to them by FPHU KRAKPOL, with their consent, by electronic mail.
  15. Consumer Rights Act – the Consumer Rights Act of 30 May 2014 (as amended).
  16. Act on Providing Services by Electronic Means – the Act of 18 July 2002 on Providing Services by Electronic Means (as amended).
  17. Electronic Communications Law – the Act of 12 July 2024 – Electronic Communications Law (as amended).
  18. Civil Code – the Act of 23 April 1964 – the Civil Code (as amended).


2. General provisions

  1. The Terms and Conditions specify the conditions of use of the Service, as well as the scope of rights and obligations of FPHU KRAKPOL and Users, including in particular the conditions for Users to purchase Tickets. In section 7, the Terms and Conditions also specify the conditions for the organization of Concerts by FPHU KRAKPOL and participation in them by Participants.
  2. The Terms and Conditions also constitute the rules and regulations referred to in Article 8 of the Act on Providing Services by Electronic Means.
  3. FPHU KRAKPOL provides the following services electronically (through the Service):
  4. a functionality enabling online purchase of a Ticket, i.e. conclusion of a Ticket sales agreement for a Concert organized by the Organizer;
  5. delivery of the Newsletter to Users,

provided that delivery of the Newsletter requires the User’s appropriate consent, provision of relevant data enabling its delivery, and access to the Newsletter depends on FPHU KRAKPOL’s decision to prepare and publish it.

The User shall bear the cost of contacting FPHU KRAKPOL according to the operator’s tariff.

  1. FPHU KRAKPOL contacts Users through the Service, by e-mail, via the Newsletter, or by telephone.
  2. It is prohibited for Users to provide unlawful content when using the Service.
  3. For proper cooperation with FPHU KRAKPOL’s ICT system (the Service), the ICT system used by the Customer should meet the following minimum technical requirements:
  4. provide access to the Internet;
  5. have an installed web browser (e.g. Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Safari) in the latest stable version provided by the manufacturer;
  6. the web browser must have Java Script and Cookies enabled;
  7. have a minimum screen resolution of 1024x768 pixels, while the recommended screen resolution is 1280x800 pixels;
  8. other requirements that will be provided before the conclusion of an agreement concerning a specific service of FPHU KRAKPOL, if performance of that service requires meeting such requirements;

  10. The agreement for the provision of electronic services concluded on the basis of these Terms and Conditions is concluded at the moment the User accepts the Terms and Conditions. This agreement may be terminated under the rules set forth in the applicable provisions of law, as well as – to the extent permitted by applicable law – under the rules set forth in the Terms and Conditions.
  11. In order to satisfy the requirements of the Act on Providing Services by Electronic Means, FPHU KRAKPOL hereby informs that the use of services provided electronically through the Internet involves risk. The basic threat is the possibility of the ICT system being infected by so-called viruses, worms and Trojan horses. To avoid the risks related thereto, it is recommended that persons using the Service install antivirus software on their device and keep it up to date.
  12. If FPHU KRAKPOL offers services other than those described in the Terms and Conditions, other Terms and Conditions or contract templates may apply to those other services.
  13. Performance of unsolicited service for the Consumer takes place at FPHU KRAKPOL’s risk and does not impose any obligations on the Consumer on that account. The Consumer’s lack of response to unsolicited service does not constitute the Consumer’s consent to conclude any agreement.
  14. FPHU KRAKPOL is entitled to send commercial information to the Customer’s e-mail address in accordance with the provisions of the Act on Providing Services by Electronic Means and the Electronic Communications Law. This may only take place after the Customer has previously given express consent by clicking the checkbox.
  15. Pursuant to Article 8(1)(2) of the Act on Providing Services by Electronic Means, all persons using the Service may access the Terms and Conditions continuously and free of charge by going to the “Regulamin” tab visible on the Service’s homepage. The Terms and Conditions may also be downloaded as a .pdf file and printed. Moreover, use of any of the services described in section 2.3 of the Terms and Conditions requires prior acceptance thereof.
  16. The User is obliged to use the Service in a manner consistent with the Terms and Conditions and the provisions of law. The User shall bear sole responsibility for the content of the data provided by him in the Service. Users are prohibited from taking any actions that may disrupt the provision of Services by FPHU KRAKPOL, in particular the operation of the Application.
  17. The User is obliged to use the Service in a manner consistent with the Terms and Conditions, the provisions of law, good practice and principles of social coexistence. In particular, the User may not publish prohibited content, which shall mean in particular content that:
  18. violates the provisions of law or the provisions of the Terms and Conditions or the Application Agreement;
  19. infringes any rights of third parties, in particular copyrights and image rights, as well as personal rights;
  20. contains, supports, offers or promotes nudity or pornographic content;
  21. contains, supports, offers or promotes other prohibited content or content contrary to good practice, in particular content related to sexual exploitation of children or adults;
  22. contains, supports, offers or promotes content related to terrorist activity, crime, violence (including violence against animals) or the use of substances whose possession is prohibited;
  23. contains, supports, offers or promotes behavior, actions or works that may be considered dangerous or threatening to life or health;
  24. contains, supports, offers or promotes sexual services, arms trade, trade in any materials or substances whose possession is prohibited, whose trade is prohibited, or in respect of which the law requires a permit for possession or trade;
  25. contains vulgar language;
  26. serves to conduct activity competitive to that of the Service Provider;
  27. constitutes advertising, promotional or marketing content;
  28. promotes hatred for any reason, including due to gender, sexual, racial, ethnic or religious affiliation, or contains threats;
  29. encourages violation of the law;
  30. violates the privacy of other persons;
  31. damages the reputation of the Service Provider or the Service Provider’s partners;
  32. insults or offends other Service Recipients, Users, including on grounds of gender, sexual, racial, ethnic or religious affiliation, or contains threats;
  33. is false;
  34. is spam or trolling;
  35. contains, supports, offers or promotes other content or behavior contrary to good practice or principles of social coexistence.


3. Newsletter

  1. The agreement for the provision of the service referred to in section 2.3.2 – the Newsletter – is concluded by providing the Customer’s e-mail address and then clicking the activation link sent to the provided e-mail address.
  2. In order to conclude the Newsletter service agreement, it is necessary to accept the provisions of the Terms and Conditions by clicking the appropriate checkbox.
  3. Termination of the Newsletter service agreement takes place by clicking the deactivation link contained in every e-mail containing the Newsletter.
  4. The Newsletter service is free of charge.
  5. The Newsletter service may be available only periodically or may be completely unavailable depending on FPHU KRAKPOL’s decision. The Newsletter may be sent irregularly or may periodically not be sent at all.


4. Purchase of tickets through the Service

  1. The Service enables the purchase of Tickets (conclusion of a Ticket sales agreement with FPHU KRAKPOL) for Concerts.
  2. If FPHU KRAKPOL is not the Organizer, it provides online Ticket sales services for Concerts and is responsible for the proper operation of the Service, performance of the obligation arising from the Ticket sales agreement, i.e. delivery thereof in accordance with the Order, and for the conformity of the Ticket with the sales agreement, i.e. for ensuring that the sold Tickets enable participation in the Concert in accordance with the selected Ticket. FPHU KRAKPOL may be the Organizer of Concerts and in such case shall be responsible for the proper organization of those Concerts of which it is the Organizer.
  3. A person concluding a Ticket sales agreement on behalf of a legal person or an organizational unit without legal personality to which the law grants legal capacity, as well as on behalf of any third party (such as e.g. an employer), by concluding a Ticket sales agreement, declares that he is duly authorized to represent that entity or person.
  4. Information available through the Service concerning Tickets (in particular their date, venue, subject matter and price) does not constitute an offer within the meaning of Article 66 of the Civil Code, but only invitations for the User to submit an offer to conclude a sales agreement for a Ticket on his behalf, as defined in Article 71 of the Civil Code.

After becoming acquainted with the Terms and Conditions, in particular with the information referred to in sections 4 and 5 of the Terms and Conditions, in order to purchase a Ticket, the User selects from the list of Concerts available in the Service the Concert for which he wishes to purchase a Ticket, selects the option “add to cart”, “dodaj do koszyka” or similar, then fills in the relevant forms (in particular the form described in section 4.6) available in the Service and accepts the Terms and Conditions by checking the appropriate checkbox and potentially other mandatory checkboxes, and the procedure is completed by the User clicking the button bearing the words “Złóż zamówienie”, which is tantamount to the User confirming that the form has been completed correctly and that the User is aware that performance of the agreement entails an obligation to pay the Ticket price specified in detail in the description of the selected Concert. An Order submitted in this manner constitutes an offer by the User to conclude a Ticket sales agreement within the meaning of the Civil Code.
  7. The User wishing to conclude a Ticket sales agreement with FPHU KRAKPOL, after selecting the Concert for which he wishes to purchase a Ticket, fills in a form by providing, selecting or accepting the following data and information:


Mandatory information:

  1. the number of Tickets the User wishes to purchase;
    (subject to any limits described in section 4.7.)
    and then, after selecting the “proceed to checkout” button:
  2. the User’s first and last name;
  3. the User’s e-mail address;
  4. the User’s contact telephone number;


Optional information or information available only for selected Concerts:
5. first and last names of the persons for whose benefit the Tickets are being purchased*;
(if a Personalized Ticket is being purchased pursuant to section 4.7.1.)
6. the User’s correspondence (postal) address*;
(only in the case of purchasing a paper ticket pursuant to section 4.7.2.)
7. the form and type of Ticket pursuant to section 4.7., a seat in the audience or other special information concerning the Ticket;*
(only if such a choice is possible for a given Concert)
8. acknowledgement and acceptance of the Concert regulations, the Organizer’s regulations, the rules of use of the venue where the Concert takes place and the ticket sales regulations for the given Concert (if the given regulations apply to the selected Concert), as well as other regulations or separate rules applicable to the given Concert;
(if such regulations are prepared and required for acceptance for the given Concert)
9. the form of delivery of the Ticket
(only in the case of purchase of a paper Ticket).
10. VAT invoice details, if different from the data previously provided, if a VAT invoice is to be issued to the User;
11. any additional information concerning the order.

  1. Depending on the nature of the Concert and the ticket offer prepared by the given Organizer, only the following types of Tickets may be available or available for selection:
    10. 4.7.1. Personalized Ticket or bearer Ticket;
    11. 4.7.2. paper Ticket or Electronic Ticket,
    12. 4.7.3. regular Ticket or Discount Ticket.

The form of the ticket depends on the requirements and conditions presented by the Organizer. Where there is a choice between different forms, the User makes that choice by selecting the appropriate forms in the form referred to in section 4.6. The number of Tickets that may be purchased for a given Concert under one Order may be limited.

  1. By default, the available form of Ticket for purchase is a regular, electronic bearer Ticket. In the absence of separate information provided during the purchase of a Ticket in the Service, the User purchases the form of Ticket described above.
  2. Concerts may have separate regulations or other binding documents created by the Organizer, referred to in section 4.6.8. of the Terms and Conditions. FPHU KRAKPOL has no influence over their content, and acceptance of these documents may be necessary in order to conclude a Ticket sales agreement.
  3. The Electronic Ticket is sent to the e-mail address indicated by the User in the form referred to in section 4.6 of the Terms and Conditions in a form enabling digital storage (download) of the Electronic Ticket on mobile devices or computers and other similar devices of the User. The User declares that the provided electronic mail address is an address to which he has access and that he is aware that providing an incorrect e-mail address will result in the purchased Electronic Ticket (or Electronic Tickets) being sent to that address.
  4. In the case of purchase of Personalized Tickets, the User – depending on the requirements of the Organizer or FPHU KRAKPOL – may be obliged to provide the personal data of the persons who, on the basis of the Tickets, are to be authorized to participate in the Concert, in accordance with the Organizer’s requirements. Depending on the Organizer’s decision and the provisions of the Organizer’s regulations, it may be necessary to provide the data of all holders of personalized tickets or only of the User making the Ticket purchase transaction. The possible admissibility of later changing the data on the Ticket or Tickets is determined by the Organizer’s regulations or the regulations of the given Concert. In the absence of separate regulations, a change of data requires contact with FPHU KRAKPOL each time.
  5. If, after completing the form referred to in section 4.6 of the Terms and Conditions, performance of the agreement is possible, an electronic message confirming conclusion of the Ticket sales agreement (Ticket(s)) will be sent to the User’s e-mail address. This confirmation is FPHU KRAKPOL’s statement of acceptance of the offer. At that moment, the Ticket sales agreement between the Customer and FPHU KRAKPOL is concluded.
  6. The User shall pay the fee for the Ticket or Tickets in accordance with the provisions of section 5 of the Terms and Conditions.
  7. Settlement of the transactions referred to in section 4.13 above is carried out through services belonging to third parties other than FPHU KRAKPOL. To make payment in this form, acceptance of the terms and conditions of the entities described in the first sentence may be required.
  8. A User who is not a Consumer consents to the issuance of an electronic VAT invoice without the need to provide his signature and to its delivery to the e-mail address provided in accordance with section 4.6.3.
  9. The date and place of the Concert and the conditions of participation are presented by the Organizer.
  10. FPHU KRAKPOL or the Organizer may, in the period between the conclusion of the Ticket sales agreement and the date of the Concert, send the User additional information about the Concert.
  11. A Consumer concluding a Ticket sales agreement with FPHU KRAKPOL through the Service may withdraw from it within 14 (fourteen) days from the date of its conclusion. The right of withdrawal referred to in the preceding sentence may be exercised by submitting an appropriate statement in writing or by e-mail to the addresses indicated in section 2.4 of the Terms and Conditions, provided that to comply with the deadline indicated in the preceding sentence it is sufficient to send the statement to FPHU KRAKPOL before its expiry to the address: Rynek Główny 10, 31-042 Kraków. The statement of withdrawal may be made using the form attached as an appendix to the Terms and Conditions.
  12. In the event of exercising the right of withdrawal, FPHU KRAKPOL shall reimburse the Consumer for all payments made without delay, but no later than within 14 (fourteen) days from receipt of the Consumer’s statement of withdrawal from the agreement, using the same method of payment as used by the Consumer, unless the Consumer has agreed to another method of reimbursement that does not involve any costs for him.
  13. The right of withdrawal described above does not apply to the Consumer with respect to an agreement under which the Organizer has fully performed the service with the Consumer’s express consent, who was informed before the commencement of performance that after performance by the Organizer he would lose the right to withdraw from the agreement (pursuant to Article 38(1) of the Consumer Rights Act).
  14. The right of withdrawal described above also does not apply in cases where it does not apply under the provisions of law, in particular pursuant to Article 38(12) of the Consumer Rights Act, i.e. in particular with respect to the conclusion of an agreement for the provision of services related to entertainment events if the date of the service has been specified in the agreement.
  15. A User who has purchased a Ticket has the right to return the Ticket, regardless of the consumer right of withdrawal above, in the event of a change in the date or location of the Concert and in other circumstances resulting from the provisions of law.
  16. A User who has purchased a Ticket may also be entitled to withdraw from the Ticket sales agreement or return the Ticket where such a provision results from the Organizer’s regulations, the Concert regulations, or where FPHU has otherwise granted such right to the User.
  17. In the event of effective withdrawal from the Ticket sales agreement or return of the Ticket by the User, FPHU KRAKPOL shall refund the funds for the Ticket purchase immediately after receiving the funds from the Organizer. By default, the refund shall be made in the same manner as the payment was made, unless the User requests another method. For this purpose, the User must contact FPHU KRAKPOL using the addresses described in section 2.4 of the Terms and Conditions.
  18. In the event of a wish to change the data on a Personalized Ticket, the User who purchased the Ticket should contact FPHU KRAKPOL using the contact details of FPHU KRAKPOL provided in section 2.4 of the Terms and Conditions. FPHU KRAKPOL does not guarantee the possibility of changing the data, and any such change requires individual arrangements each time. FPHU KRAKPOL is not obliged to accept any request to change the data on a purchased Ticket, including in particular requests to change material elements of the Ticket submitted after the purchase of the Ticket, primarily such as: changes to the place and date of the Concert, places within the Concert (seats in the audience), the date or start time, as well as the data on the Personalized Ticket.
  19. The conditions for purchase, return or change of data on Tickets may be modified in the Organizers’ regulations or the Concert regulations and other similar documents applicable to given Concerts.
  20. When purchasing a Ticket through the Service, the User may use an additional functionality consisting in generating (through Google Maps) a route to the Concert venue from any entered location. FPHU KRAKPOL does not collect or process location data provided when using the described functionality. The route to the Concert venue and the travel time provided in this manner are approximate, and FPHU KRAKPOL is not responsible for their correctness.


5. Prices and payment for Tickets

  1. The price for a Ticket is stated each time in the Service in the description of the given Concert.
  2. The price of a Ticket may vary depending on the type and form of the Ticket, the selected seat in the audience, and other variables characteristic of the given Concert. The price of each type and form of Ticket is given for each form and type of Ticket.
  3. Ticket prices are given in Polish zloty (PLN) and are gross prices (including VAT at the applicable rate). The Ticket price may vary depending on the selected Ticket category, the selected seat in the audience, or other variables proposed by the Organizer or FPHU KRAKPOL.
  4. Unless other payment terms are specified upon conclusion of the agreement, the Customer shall pay the fee in the amount indicated in the description of the selected Ticket variant through one of the selected online payment methods:
  5. bank transfer;
  6. via the Przelewy24 service;
  7. PayPal;
  8. Blik;
  9. Apple or Google Pay.

Payments in the above forms are made through third parties in accordance with their terms and conditions, acceptance of which may be necessary in order to purchase a Ticket.

  1. The User shall bear the costs related to the selected payment method and the costs of Ticket delivery.
  2. If payment is not received within 3 days after placing the Order together with payment of the fee, FPHU KRAKPOL may withdraw from the agreement after first calling for payment within a period which, as a rule, will not be shorter than 4 days. Withdrawal becomes effective by informing, to the e-mail address indicated in the form referred to in section 4.6, about cancellation of the Order.


6. Complaint procedure

  1. Customers may report any irregularities or complaints related to any of the services provided by FPHU KRAKPOL to the address [_31-042 Kraków, Rynek Główny 10]. Complaints may also be submitted through a public postal operator within the meaning of the Postal Law Act of 23 November 2012 (Journal of Laws of 2017, item 1481), to the correspondence address provided in section 2.4.3.
  2. A complaint should contain:
  3. identification of the complaining person, with indication of the necessary identifying data, including the e-mail address (the password should not be sent);
  4. identification of the agreement, service or transaction to which the complaint relates and an indication of what the irregularity consists in.
  5. If the required information is missing, FPHU KRAKPOL will call on the complainant to supplement it.
  6. During the complaint process, FPHU KRAKPOL may request additional explanations, documents, or verification of the course of the event subject to the complaint.
  7. Complaints shall be considered within 14 business days from receipt by FPHU KRAKPOL of the complaint containing all necessary data. FPHU KRAKPOL shall immediately inform the complainant about the resolution of the complaint by electronic mail.
  8. FPHU KRAKPOL will make efforts to ensure that complaints are considered without undue delay.
  9. After exhausting the procedure regulated in this section, a User who is a Consumer may pursue claims through the courts or use legally permitted out-of-court complaint procedures, in particular mediation and permanent consumer arbitration court run by competent units of the Trade Inspection, as well as obtain assistance in this regard from the competent district or municipal consumer ombudsman (whereas FPHU KRAKPOL is not obliged to consent to the use of out-of-court complaint resolution methods). Detailed information regarding the possibility of using out-of-court procedures may be available, among others, at the offices of the competent authorities (municipal and district consumer ombudsmen, Provincial Inspectorates of the Trade Inspection) and on their websites, as well as on the websites of the Office of Competition and Consumer Protection (www.uokik.gov.pl).


7. Organization of Concerts by FPHU KRAKPOL

  1. FPHU KRAKPOL may be the Organizer of Concerts for which Tickets are available for sale in the Service. In such case, the purchase of a Ticket is also connected with the conclusion of an agreement for participation in the Concert (provision of entertainment services in the form of organization and the possibility of participating in the Concert). In such case, the provisions of section 7 of the Terms and Conditions apply to Concerts organized by FPHU KRAKPOL. Regardless of the provisions of section 7 of the Terms and Conditions, participation in a given Concert may require acceptance of separate regulations applicable to that Concert. Where the Organizer is an entity other than FPHU KRAKPOL, FPHU KRAKPOL is not responsible for the course, organization of the Concert, or the content of the regulations of such Concert, and is obliged only to the extent described in section 4.2 of the Terms and Conditions.
  2. Where FPHU KRAKPOL is the Organizer of a Concert, FPHU KRAKPOL is responsible not only for the sale of the Ticket, but also for proper performance of the service consisting in organizing and enabling the Participant to take part in the Concert. In this respect, the provisions of the Terms and Conditions shall apply accordingly, in particular: sections 4.18–4.26 and section 6 in its entirety.
  3. The Concert takes place at the time and place specified on the Ticket. FPHU KRAKPOL recommends arriving at the Concert venue at least 30 minutes earlier in order to efficiently obtain entry to the premises where the Concert is held. Arrival at the Concert venue after the starting time specified on the Ticket may result in the concert participant not being admitted to the Concert due to its prior commencement (depending on the nature of the concert and whether the participant’s entry may cause disruption).
  4. Participants are required to have a valid Ticket and, in certain cases (in particular when using Personalized Tickets or Discount Tickets), also an identity document or a document confirming the right to use a Discount Ticket. Entry to the Concert without a valid Ticket and, in certain justified circumstances, the remaining documents, is impossible. The held Ticket entitles one Participant to one-time entry to the Concert.
  5. Leaving the Concert venue (beyond the place where the Ticket was checked) results in loss of the possibility to return to the Concert.
  6. Participants and all other persons present at the Concert venue are obliged to behave in a manner that does not endanger the safety of other persons and, in particular, to comply with the provisions of the Terms and Conditions. It is prohibited to destroy infrastructure, including greenery, litter the area, destroy markings and information boards, advertising media, devices and equipment located at the Concert venue and similar items. Participants are obliged to use sanitary facilities only in accordance with their intended purpose.
  7. FPHU KRAKPOL or persons constituting the staff of the facility where the Concert is held are entitled to refuse participation in the Concert or presence at the Concert venue to a Participant who:
  8. does not possess a Ticket or another document described in section 7.4 of the Terms and Conditions;
  9. is under the influence of alcohol or other intoxicating substances;
  10. poses a threat to other Participants, concert organizers, artists or other persons present at the Concert;
  11. by his behavior hinders or prevents the undisturbed realization of the Concert;
  12. possesses weapons, explosive materials or other items that may pose a safety threat;
  13. fails to comply with the provisions of the Terms and Conditions, in particular section 7.
  14. FPHU KRAKPOL is entitled to record the Concert in any form (including audio and video), and Participants may be included in the recording as an element of the entirety of the recording.
  15. FPHU KRAKPOL is entitled to change the course of the Concert or cancel it for justified reasons that could not have been foreseen, including due to force majeure. In such case, the Ticket holder is entitled to enter the Concert on the new date or return the Ticket, of which he will be informed by FPHU KRAKPOL.
  16. If the Concert does not take place for reasons attributable to FPHU KRAKPOL, the Participant is entitled to a refund of the funds paid for the purchase of the Ticket or to the possibility of taking part in the Concert scheduled for a new date. In order to obtain a Ticket for the new date or a refund, the Participant should contact FPHU KRAKPOL through the contact addresses provided in section 2.4.
  17. Section 6 of the Terms and Conditions applies to complaints concerning Concerts organized by FPHU KRAKPOL.
  18. In matters concerning the organization of Concerts by FPHU KRAKPOL, the Participant may contact FPHU KRAKPOL at the contact addresses indicated in section 2.4.


8. Legal notice

  1. The Service was prepared on behalf of FPHU KRAKPOL.
  2. The content and structure of the Service are protected by copyright. Reproduction of data or information, in particular the use of materials and texts placed on the website (including also the Terms and Conditions), as well as fragments thereof, and photos or videos for purposes other than those expressly permitted by law without FPHU KRAKPOL’s consent is prohibited.


9. Amendment of the Terms and Conditions

  1. FPHU KRAKPOL is entitled to amend these Terms and Conditions, in particular for reasons such as changes in the law, including in particular the Act, changes in the functionality of the Service and/or changes in the scope of services provided.
  2. An amendment to the Terms and Conditions shall enter into force on the date indicated by FPHU KRAKPOL, which in each case shall not be shorter than 7 days from the date the new Terms and Conditions are made available to the e-mail address provided by the User.
  3. FPHU KRAKPOL shall inform about amendments to the Terms and Conditions by sending the new version of the Terms and Conditions with information about the provisions being changed or by making the new version of the Terms and Conditions available to the User’s e-mail address.
  4. Amendments to the Terms and Conditions shall be binding on the User unless he objects to FPHU KRAKPOL (by sending the objection to the contact addresses provided in section 2.4 of the Terms and Conditions) within 7 days from the date on which he was notified about the amendment of the Terms and Conditions. An amendment to the Terms and Conditions does not apply to Tickets purchased before the amendment enters into force.
  5. An objection must be made, under pain of nullity, in writing or in documentary form in the form of an e-mail message.


10. Final provisions

  1. Any disputes arising between FPHU KRAKPOL and a Customer who is not a Consumer shall be submitted to the court having jurisdiction over the address indicated in section 2.4.3 of the Terms and Conditions.
  2. Polish law shall apply to the assessment of the rights and obligations of the parties arising from the Terms and Conditions where the Customer is not a Consumer. Where the Customer is a Consumer, jurisdiction of the law shall be determined in accordance with the relevant provisions.
  3. FPHU KRAKPOL is not bound by any additional, non-mandatory codes of good practice or other documents of this type, which does not limit the fact that already under universally binding provisions of law FPHU KRAKPOL is obliged not to infringe the principles of fair competition and not to apply unfair market practices.
  4. Point numbers (sections) referred to in the Terms and Conditions without closer designation mean the relevant editorial units of the Terms and Conditions.
  5. The Terms and Conditions enter into force on [_1.12.] 2025.
